§ 8116-2.5.2. Density bonus allowance for qualified land donation for very low income housing.

  • If the requirements of Section 8116-2.5.1 are satisfied, the applicant shall be entitled to at least a fifteen (15) percent increase above the otherwise maximum allowable residential density for the entire development, as follows (Government Code Section 65915(g)(1)):

    The increase in density bonus authorized by this Section shall be in addition to any increase in density allowed for providing a minimum affordable housing component in accordance with Section 8116-2.2, up to a maximum combined mandated density increase of thirty-five (35) percent if an applicant seeks an increase pursuant to both this Section and Section 8116-2.2. (Government Code Section 65915(g)(1) and (2).)

    All density calculations resulting in fractional units shall be rounded up to the next whole number. (Government Code Section 65915(g)(2).)
