§ 8109-4.4.2. Permit standards.

  • Discretionary permits shall not be granted within areas with a "MRP" overlay zone designation if the use will significantly hamper or preclude access to, or the extraction of, a mineral resource, except where one or more of the following findings can be made:

    a.

    Such use is primarily intended to protect life or property.

    b.

    Such use provides a significant public benefit.

    c.

    The resource is not present at the site.

    d.

    Extraction of the resource is not technically or economically feasible.

    e.

    Extraction of the resource is not feasible due to limitations imposed by the County.
